By using the Boulevard Super App services: the Boulevard app, website, and API-accessible databases ("Service") you ("The Client") are agreeing ("Agreement") to be bound by the following terms and conditions ("Terms & Conditions").
Boulevard Super App is a mobile application and service platform operated by Boulevard Services LLC, a UAE establishment duly registered under the laws of the United Arab Emirates. We strive to ensure the accuracy of information on our platform, however, information provided by third-party service providers remains their responsibility. Boulevard reserves the right to update these Terms with 30 days prior notice. All changes will be posted on this platform with an updated publication date.
Services
Boulevard Super App is your all-in-one platform connecting you with local UAE businesses. Our services include: Grocery delivery, Restaurant ordering, Beauty & SPA bookings, Travel arrangements, Insurance services, Retail shopping, Desert & Flowers (sweets and flowers), Real Estate listings, Laundry services, Medical appointments, Motors (automotive services), Photography services, and Typing Services. Every transaction you make supports the "Make in the Emirates" initiative, empowering 382 local sellers and 665 factories across the UAE.
Basic Terms
- If you do not agree, you should decline this Agreement and immediately stop using the Service. Access to the Service is permitted only to those that fully agree with the terms and conditions of this Terms of Service agreement.
- You agree that this Terms of Service Agreement and the relationship between the parties shall be exclusively governed by the laws of the United Arab Emirates without regard to conflict of law principles, or international conventions. The exclusive jurisdiction for any dispute resolution under the Arbitration Rules of the Dubai International Arbitration Centre (DIAC).
- You must provide your legal full name, a valid email address, and any other information requested by the Service Provider in order to complete the signup process and use the Service.
- The Service Provider cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
- The Client undertakes to maintain full confidentiality over the Client's passwords related to the Service and the Client's Account. If the Client becomes aware of any unauthorized use of its password or of the Client's Account, the Client must notify the Service Provider immediately.
- You are responsible for all Content posted and activity that occurs under your organization's account, even when Content is posted by other individuals your organization has granted access to the Service.
- You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws of The United Arab Emirates or your jurisdiction (including, but not limited to copyright and privacy laws).
- You undertake not to harass, threaten, abuse or harm the Service Provider or other users of the Service in any way.
Cancellation and Termination
- You are solely responsible for properly canceling your service. You must inform Boulevard of the wish to terminate the service via written confirmation.
- All of your Content can be immediately deleted from the Service upon cancellation. This information can not be recovered once your account is canceled.
- If you cancel the Service before the end of your current paid-up month, your cancellation will take effect immediately and you will not be charged again.
- Boulevard reserves the right to suspend or terminate your account for the following reasons: (1) Violation of these Terms, (2) Illegal activities or fraud, (3) Non-payment of fees after 30 days notice, (4) Abusive behavior towards service providers or other users, (5) Multiple complaints from service providers. You will receive written notice 7 days before termination, except in cases of severe violations or illegal activities.
- Client agrees to pay Boulevard any and all fees as billed. Refunds may be issued in the following cases: (1) Service not delivered due to Boulevard fault, (2) Technical errors preventing service access, (3) Double charging or billing errors, (4) As required by UAE consumer protection laws. Refund requests must be submitted within 14 days of the incident.
Modifications to Service
- The Service Provider reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
- Prices of all Services, including but not limited to monthly subscription plan fees, are subject to change upon 30 days' written notice via email and in-app notification. Price changes will not affect active subscriptions until renewal. Users have the right to cancel before price changes take effect without penalty.
- The Service Provider shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
- The Client acknowledges and agrees that the form and nature of the Service may change from time to time without prior notice to the Client.
Content and Data Processing
- The Service Provider's Content is protected by copyright. The Client may not copy, distribute, modify, rent, lease, loan, sell distribute, create derivative works, or reverse engineer any part of the Service without permission.
- The Service Provider claims no intellectual property rights over the content you enter, upload or provide to the Service ("Client Data"). The content uploaded by you remains yours.
- The Service provider does not pre-screen Content, but the Service Provider has the right to refuse or remove any Content that is deemed unacceptable.
- The Client undertakes not to create, transmit, display or make otherwise available any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
- By uploading Client Data to the Service, the Client authorizes Boulevard to process the Client Data in accordance with applicable laws and regulations.
- Boulevard will process data on behalf of the Client until the termination of the Services. Upon termination, data is retained for 3 months for the following purposes: (1) Completing pending transactions, (2) Resolving disputes or complaints, (3) Preventing fraud and ensuring security, (4) Complying with legal obligations. After 3 months, all personal data is permanently and irreversibly deleted from our servers using secure deletion methods that meet international data destruction standards. Users receive confirmation email upon final deletion.
- Boulevard ensures that persons authorized to process the personal data have committed themselves to confidentiality or are under an appropriate statutory obligation of confidentiality.
General Conditions
- Your use of the Service is at your sole risk. The service is provided on an "as is" and "as available" basis.
- The Service Provider does not represent or warrant that the Client's use of the Service will meet the Client's requirements or will be uninterrupted, timely, secure or free from error.
- Boulevard is committed to maintaining accurate and up-to-date information. We implement verification processes and regularly update our database. However, information provided by third-party service providers remains their responsibility, and we act as a facilitating platform. For critical services (medical, travel, insurance, real estate), we strongly recommend users to verify essential details directly with service providers before making final decisions. Boulevard will investigate and correct any reported inaccuracies within 48 hours.
- Technical support is available via email and customer support channels.
- No warranties apply to the Service except to the extent expressly stipulated in the Agreement.
- The Service Provider is not liable for any direct, indirect or consequential damage (including loss of profit, loss of data, loss of goodwill) which may be incurred by the Client.
- You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service.
- You understand that Boulevard uses third-party vendors and hosting partners to provide the necessary infrastructure required to run the Service.
- You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without the express written permission of Boulevard.
- The Client indemnifies Boulevard for any and all claims, liabilities, losses, expenses, damage and costs resulting from the breach of the Agreement.
- Boulevard may remove Content and Accounts containing Content that are deemed unlawful, offensive, threatening, or otherwise objectionable.
- You understand that the technical processing and transmission of the Service, including your Content, may involve transmissions over various networks.
- You must not upload, post, send out, or transmit unsolicited emails, SMSs, or "spam" messages from the Service.
- The failure of Boulevard to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision.
- The Terms of Service constitute the entire agreement between you and Boulevard and govern your use of the Service.
- Any disputes related to the Agreement are to be solved by means of negotiations. If not resolved within 30 days, it shall be referred to arbitration under the Dubai International Arbitration Centre (DIAC).
